Appeal
Title: An Appeal to Protect the Rights of the Korean Community
Dear Members of the Korean Community,
The revised Article 5 of the Korean Association's bylaws contains significant issues that severely limit the fundamental rights and representation of community members.

On December 30, 2023, the Korean Association held a General Assembly at 12:00 PM, a time that made it difficult for the majority of members to attend.
Unlike the usual 7:00 PM schedule, this time adjustment appears to have favored certain groups within the Association.
Furthermore, while the Association announced the intent to revise the bylaws,
there was no subsequent announcement regarding the outcomes of the General Assembly.
According to the revised bylaws, even if an individual fulfills the conditions of paying the membership fee and participating in at least one event, the Board reserves the right to review and decide on membership eligibility if deemed necessary.
Additionally, the failure to announce the changes in membership fees, particularly for single households (originally $20), raises suspicions that the intent was to exclude younger Koreans under the pretext of unpaid fees.
This practice suggests a concentration of control in the hands of the Board, transforming the Association from a community for all members into an exclusive body dominated by a select few.
Issues with the Revised Bylaws
- Violation of Equal Participation Rights
Arbitrarily screening membership eligibility undermines the Association's inclusivity and infringes on the equal rights of all members to participate in its activities. - Restrictions on Membership Fees and General Assembly Attendance
- While it is understandable that membership fees are essential for the Association's operations, the requirement to pay fees at least 24 hours before the General Assembly lacks clear justification.
- This clause appears to allow the Executive Committee and Board to monitor how many dissenting members may attend, potentially minimizing the chances of unfavorable voting outcomes.
- Furthermore, if fees must be paid 24 hours before the General Assembly, it is unclear how the Board verifies compliance with Article 5 and immediately convenes to evaluate membership eligibility. This lack of transparency raises serious concerns.
- While it is understandable that membership fees are essential for the Association's operations, the requirement to pay fees at least 24 hours before the General Assembly lacks clear justification.
- Mandatory Participation in One Event Per Year
- While it is ideal to encourage participation in events, the policy fails to consider the realities of Korean community members who are preoccupied with their livelihoods.
- Although many Koreans may not be able to participate, participation should be voluntary, and forcing individuals to meet a quota of attending at least one event is unfair.
- Denying membership rights based on participation creates an exclusive structure, enabling a small group to control the Association while excluding others.
- The Korean Association risks becoming an organization for a select few rather than representing the interests of all Koreans.
- While it is ideal to encourage participation in events, the policy fails to consider the realities of Korean community members who are preoccupied with their livelihoods.
- Potential Violation of the Canadian Human Rights Act
- All individuals have the right to participate in organizations without discrimination based on gender, age, nationality, or other factors. Denying membership based on these arbitrary conditions may violate human rights protections.
- All individuals have the right to participate in organizations without discrimination based on gender, age, nationality, or other factors. Denying membership based on these arbitrary conditions may violate human rights protections.
- Potential Violation of the Canada Not-for-Profit Corporations Act
- Nonprofit organizations must operate with fairness and transparency. Restricting membership eligibility to benefit specific groups raises serious concerns about compliance with nonprofit governance laws.

Conclusion
Dear members, we cannot stand by while these unjust bylaws and practices limit your rights.
The Korean Association must represent all Koreans, not just a select few.
We urge you to recognize the significant infringement on your rights caused by these revised bylaws and join us in raising your voices to protect our community's rights.
Korean Community of Manitoba Seeking Normalization of the Korean Association.
